“Legally, the concept of ‘family’ is defined by specific prerequisites, primarily centered around a recognized marriage. The law also imposes restrictions on ending this legal status. Family registration serves various societal purposes, including:
1. It forms the fundamental unit of societal organization, as per Article 16 of the Universal Declaration of Human Rights.
2. It serves as the primary economic unit where most productive activities occur.
3. It provides a framework for satisfying sexual expression.
4. It ensures the continuity of society through procreation.
5. It offers a structure for companionship among family members.
The objectives of family law include:
1. Defining the status and rights of family members over each other and their property.
2. Providing protection, especially for vulnerable family members like children.
Regarding pairing families, they consist of one man and one woman, allowing for polygamy and occasional infidelity by the man but strict fidelity by the woman. Restrictions on sexual relations are applied, with a progressive stage for conjugal relations. In pairing families, women are limited to their husbands, who cannot be their brothers.
The enactment of the Divorce Ordinance was based on the Indian Divorce Act of 1869, providing relief for monogamous marriages. This remains the current practice, replaced by the Matrimonial Causes Act in 1941. Additionally, the Separation Courts (Separation & Maintenance Ordinance) were established in 1928 to allow judicial separation and maintenance for monogamous marriages. The Mohammedan Marriage & Divorce Registration Ordinance (1906) handles the registration of Islamic marriages and divorces but is primarily procedural. In 1946, the Hindu Marriage Divorce and Succession Ordinance required monogamous marriages among Hindus and extended reliefs available under the Matrimonial Act and the subordinate Courts separation and maintenance Act.
The constitutional basis for applying different legal systems is rooted in historical arguments and the right to freedom of conscience, including freedom of religion. The Marriage Bill of 1976 sought to harmonize family laws but was considered unconstitutional due to its historical and religious implications. Under the Draft Bill to amend the Constitution, Parliament may recognize marriages under various traditions and religious, personal, or family laws, preserving the multiplicity of family laws in Kenya.”
